1.About these terms
Citify is provided by its operator (“Citify”, “we”, “us”).
These terms govern your use of the Citify website and iPhone app (the “Service”). By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service.
Our Privacy policy explains how we handle personal data and forms part of these terms.
2.Eligibility and accounts
You must be at least 13 years old, or the minimum age required in your country, to use the Service. If you are under the age of majority, you confirm that a parent or guardian has agreed to these terms.
You agree to give accurate account information, keep your sign-in details confidential and tell us promptly if you believe your account has been used without permission. You are responsible for activity under your account.
3.Your licence to use Citify
Subject to these terms, we grant you a personal, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial travel planning.
4.Acceptable use
You agree not to:
- break any law, or infringe the rights of others, through the Service;
- harass, threaten or abuse other people, including members of shared trips;
- upload content that is unlawful, misleading or harmful, or that you have no right to share;
- access accounts or data that are not yours, or test, probe or circumvent security measures;
- scrape, copy or extract content from the Service in bulk, or use automated means to access it except through features we provide;
- interfere with the Service, overload it or disrupt other users; or
- resell, sublicense or commercially exploit the Service without our written permission.
5.Your content
You keep ownership of the trips, notes and other content you add. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy and display that content solely to operate the Service for you and the people you choose to share it with. This licence ends when the content is deleted, except where it remains in a trip shared with others.
You are responsible for your content and confirm that you have the rights needed to add it.
7.Travel information and AI features
Routes, opening times, prices, descriptions and AI-generated answers are provided for general guidance only. They may be incomplete, out of date or inaccurate. Prices come from third parties and may change before you book.
You are responsible for checking important details, such as opening hours, entry requirements, safety conditions and accessibility, before you rely on them. Use your own judgement when travelling.
8.Bookings and third-party services
Citify does not sell travel products and never takes payment. Links to flights, stays and other services take you to third parties. Any booking is a contract between you and that provider, on its terms. We are not responsible for third-party services, content or availability.
9.Intellectual property
The Service, including its software, design, Citify name and logo, and the written guides about places, belongs to us or our licensors and is protected by intellectual-property laws. Place photographs are used under the licences of their authors, who are credited alongside them. Nothing in these terms transfers ownership of any of this to you.
10.Changes and availability
We may change, add or remove features, and we may suspend or discontinue the Service. We will try to give reasonable notice of changes that significantly affect you. We do not guarantee that the Service will be uninterrupted or error-free.
11.Suspension and termination
You may stop using the Service and delete your account at any time from your profile.
We may suspend or close your account if you seriously or repeatedly breach these terms, misuse the Service or put other people at risk, or where the law requires. Where appropriate, we will tell you why. Sections that by their nature should survive termination, including intellectual property, disclaimers and limitation of liability, continue to apply.
12.Disclaimers
The Service is provided free of charge “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
13.Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, data, bookings or travel arrangements, arising from your use of the Service or reliance on its information.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by law. If you are a consumer, you keep all rights you have under the mandatory laws of your country of residence.
14.iPhone app
If you downloaded Citify from the App Store, these terms are between you and us, not Apple. Apple is not responsible for the app, its maintenance or support, or any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Your use of the app must also comply with the App Store’s usage rules.
15.Changes to these terms
We may update these terms. If we make a material change, we will notify you in Citify before it takes effect. Continuing to use the Service after that date means you accept the updated terms. If you do not accept them, you may delete your account.
16.Governing law
These terms are governed by the laws of the country in which Citify’s operator is established. This does not deprive you of the protection of mandatory consumer laws in your country of residence, or of your right to bring proceedings in your local courts.
